1. Who we are
Orbitly is provided by [Legal business name] ("we", "us"). By creating an account or using the service you agree to these terms and are entering into a contract with [Legal business name]. If you use Orbitly for an organization, you confirm you have authority to bind it; otherwise you confirm you are of legal age.
2. The service
Orbitly provides website analytics, including a tracking script, dashboards and a live visitor globe. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.
3. Your account
Keep your login details confidential and provide accurate information. You are responsible for activity under your account.
4. Acceptable use
- No unlawful use, fraud or spam.
- No infringement of intellectual property rights.
- No interference with security, including malware, probing, scraping or circumventing plan limits.
- No reverse engineering, resale or redistribution of the service.
- You must have a lawful basis to collect analytics on the websites you track.
5. Intellectual property
We retain ownership of the service, its software, documentation and branding. You keep ownership of your data and grant us a limited licence to process it solely to provide the service.
6. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. Paid plans renew monthly until cancelled.
7. Service level
We work hard to keep Orbitly available, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the service is provided "as is" without implied warranties.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your account ends you may export your data within 30 days, after which it is deleted.
9. Liability
Our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits or data, except where the law does not allow this limitation.
10. Changes and contact
We may update these terms and will note the date above. Questions: [support email].
